SMOKING POLICY
The Gin
Mill Restaurant & Tavern has an established reputation for being
a warm neighborhood "pub" where patrons can relax with
food and beverages in a comfortable atmosphere. For over twenty years,
we have welcomed and accommodated both smokers and non-smokers
alike.
And we will continue with this traditional policy.
The Gin
Mill Restaurant & Tavern is not subject to the smoking
restrictions of the City of Albuquerque Ordinance O-03-85, enacted and
published on 03/27/2003, which amends Chapter 9, Article 5, Part 5, ROA 1994,
of the
City of Albuquerque Eighth Council Bill No. 0-51,
the Albuquerque Clean Indoor Air
Ordinance, dated September 12, 1988.
[NOTE: Chapter 9, Article 5, Part 5, ROA 1994 eliminates designated
smoking areas and prohibits smoking in certain establishments.]
Since the Gin Mill Restaurant & Tavern exceeds fifty percent of
annual gross revenues from the sales of alcoholic beverages in the entire
non-restaurant bar premises, it qualifies as a "non-restaurant bar"
as set forth in
Section 1-A of Ordinance O-03-85.
Therefore, the Gin Mill Restaurant & Tavern
is exempt from any smoking restrictions
as stated in Section 9-5-5-5, Prohibition of Smoking in Public Places,
of the amended Bill No. 0-51.
